1. About the Service

MediBora provides digital health and maternal health support services that may include wearable monitoring, digital communication, health information management, dashboards, alerts, educational information and related support. Specific features may vary by product, pilot, partner or subscription.

2. Not a Replacement for Emergency Care

MediBora services are intended to support monitoring, communication and access to health information. They are not a substitute for emergency medical care, diagnosis or treatment by a qualified healthcare professional. Users experiencing an emergency should contact the appropriate emergency service or seek immediate medical attention.

3. Health Information and Alerts

Where monitoring features are enabled, readings and alerts may be affected by device limitations, connectivity, user input, sensor placement, environmental conditions and other factors. An alert or risk score is a support tool and should not be treated as a definitive medical diagnosis.

4. User Responsibilities

• Provide accurate information and update it when necessary.
• Use devices and services according to MediBora instructions.
• Keep account credentials and devices reasonably secure.
• Do not misuse, reverse engineer, disrupt or attempt unauthorised access to MediBora systems.
• Seek appropriate professional medical care when symptoms or concerns require it.

5. Healthcare Providers and Partners

Where MediBora services are used through a hospital, clinician, insurer, NGO, government programme or other partner, additional terms may apply. Those organisations may have their own privacy notices, consent requirements and professional responsibilities.

6. Intellectual Property

Unless otherwise stated, MediBora owns or has the right to use its software, platform content, branding, documentation, designs and other intellectual property. Users may use the service only for its intended purpose and may not copy, sell, modify, distribute or commercially exploit MediBora materials without written permission.

7. Availability

MediBora will make reasonable efforts to keep its services available but does not guarantee uninterrupted or error free operation. Services may be unavailable due to maintenance, connectivity issues, device limitations, third party services or circumstances outside our reasonable control.

8. Third Party Services

Some services may rely on telecommunications networks, hosting providers, payment providers, mapping services, messaging platforms or other third party services. Their availability and terms may affect the MediBora service.

9. Limitation of Liability

To the extent permitted by applicable law, MediBora will not be responsible for indirect or consequential losses arising from use or inability to use the service. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

10. Suspension or Termination

MediBora may suspend or terminate access where reasonably necessary for security, misuse, non payment, legal compliance or other legitimate operational reasons. Where appropriate, users will be given notice and an opportunity to resolve the issue.

11. Governing Law

These Terms are intended to be governed by the laws of Kenya, subject to any mandatory legal requirements that apply to the relevant user or service.

12. Changes to the Terms

MediBora may revise these Terms from time to time. The updated version will be made available through appropriate channels and will state its effective date.
